Step-by-Step Instructions

Use the Basic Method for simple divisions, and the Advanced Method for more complicated ones.  

Basic Method.   This is for small, simple divisions.  Use the advanced method if there are a lot of items to be distributed, or if you want to keep some of the items in the family, or if you want to allow outsiders to bid, or if you want to give some of the items to certain individuals, or if the divisions are unequal.

Step 1:   Decide who's in charge and who's keeping records.  

Step 2:  Identify the recipients and decide on their shares. 
Step 3:  Get the recipients to agree on the rules.

Step 4:  Make a list of what you wish to distribute at this time.

Step 5:  Have the recipients submit bids.
Step 6:  Award the items to highest bidders.
Step 7:  When all of the bidding is done, collect money from those with negative cash balances and distribute the money and property.
Step 8:  (Optional) Tell us how the EqualShares method worked for you.

 

Advanced Method.   This is for more complicated divisions.  Before proceeding, we recommend that you use the Basic Method to distribute a few unimportant items so that you can get an idea of how the method will work.

Step 1:   Decide who's in charge and who's keeping records.  

Step 2:  Identify the recipients and decide on their shares. 
Step 3:  Get the recipients to agree on the rules.

Step 4:  Make a list of what you wish to distribute at this time.

Step 5:  (Optional) Ask the recipients questions about the items on the list.   
Step 6:  (Optional)  Identify heirlooms that shouldn't be sold to others.
Step 7:  (Optional) Determine entitlements and appraise certain items.
Step 8:  (Optional)  Allow outside parties to bid on certain items.
Step 9:  (Optional)  Divide the items to be auctioned into lots.
Step 10:  Set up share accounts. 
Step 11:  Have the recipients submit bids.
Step 12:  Award the items to highest bidders.
Step 13:  Update the share accounts.
Step 14:  (For those who have divided their property into lots.) Repeat steps 11 through 13 for each lot until all the lots are "sold."
Step 15:  When all of the bidding is done, collect money from those with negative cash balances and distribute the money and property.
